Terms of Service

The service is provided by AutoM8 Tech, Bartle House, Oxford Court, Manchester, England, M2 3WQ, registered in England and Wales, company number 12576758, VAT number 391435096.

Where you accept these terms on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" means that organisation.

AutoM8 provides AI-assisted driver safety technology: in-vehicle devices and a platform that records, analyses and reports on vehicle telemetry, driver-behaviour events and camera footage.

AutoM8 is a driver assistance and monitoring system, not a substitute for a driver. It does not make a vehicle autonomous. The driver remains responsible for the vehicle at all times and must comply with all applicable traffic law.

You are responsible for keeping your login credentials confidential and for activity carried out under your account. Tell us promptly at khizzer@autom8tech.ai if you believe an account has been compromised.

You agree not to:

• use the service unlawfully, or to monitor people covertly;
• attempt to gain unauthorised access to the service, other customers' data, or the infrastructure behind it;
• interfere with the service's operation, including by automated traffic that degrades it for others;
• reverse engineer, resell or sublicense the service except as these terms or the law allow.

You retain all rights in the data your fleet generates. You grant us the rights needed to host, process and display it in order to provide the service.

Where we process personal data on your behalf we do so as your processor under a data processing agreement, and only on your documented instructions. You are responsible for having a lawful basis for the recording you configure, and for informing your drivers about it. Our Privacy Policy explains how we handle personal data.

Where a free trial is offered, its length is stated at sign-up and the service may be withdrawn at the end of it unless a paid subscription is agreed. Fees, billing period and any hardware costs are set out in the order or quotation you accept. Unless stated otherwise, fees are exclusive of VAT.

We work to keep the service available and secure, but we do not guarantee uninterrupted availability. We may suspend access for maintenance, or where continued access would put the service, its users or their data at risk.

Any performance figure published on this website or in our materials is an engineering target based on our own internal testing and modelling. It is not a guaranteed or independently verified customer result, and it does not form part of any contract. Actual outcomes vary by fleet, driving conditions and deployment.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of anticipated savings, and our total liability in any twelve-month period is limited to the fees paid by you for the service in that period.

Either party may end a subscription in accordance with the order terms. We may suspend or terminate access immediately for a material breach of these terms. On termination we will make your data available for export for 30 days, after which it may be deleted.

We may update these terms. Where a change materially affects an existing customer we will give reasonable notice by email. Continued use after a change takes effect means you accept the updated terms.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
